good afternoon the e f now intensifying its f calls for the arrest resignation and of the speaker of the national assembly mosupyoe maphorisa nqakula after she failed bid to interdict in her court her arrest in the high ntsoane today the e f f adamant that maphorisa nqakula stay as speaker integrity undermines the of the national assembly calling on all political parties in parliament to back of no the motion confidence against her she's accused rocketing over four of million rand a defence in kickbacks from contractor while she was the minister of defence meanwhile the national prosecuting authority says it can't give details in the process that will follow today's court decision we don't discuss issues of arrests evidence social issues witnesses list of investigative processes in the media but obviously the wheels of justice will now be motion as in you were listening to which was the judgment well resigned and we've always that indeed maintained this is unprecedented unnecessary and it was for us to be brought as we to court have always maintained of arrest that the process will be done similar n c says the a it will enforce that step aside party's policies with regards to the national assembly speaker the a n c has noted the judgment handed down by the north high gauteng court involving comrade nausea siviwe maphorisa magagula we do wish to assure south africans of the a members n c supporters a n c of the and all other patriots that the a n c is committed to respecting the rule of law safeguarding our constitutional democracy and will then invoke relevant sections of a n c's constitution the in as far the matter involving as the speaker of parliament is concerned the da's chief whip sbu radebe no confidence wants motion against her to be this week debated of course we were watching the the the court judgement with interest does have because it an impact and a bearing on the urgency that we have asked parliament prioritise to the motion of no confidence speaker in the of course we always held that the outcomes whatever of the case that p a is pursuing the m it does not mean that parliament must shake off its responsibility holding the of speaker to account we've long that held the allegations that the speaker is facing are of a grave nature and that in her nobody in her high offices and she indicated her responsibilities as the leader of the n a in parliament should be facing allegations such and still retain their position we've and therefore we've we've initially called for her to step down but clearly the now digging the speaker is in her heels does to resign not want and so we've brought this motion and now we are demanding the deputy to schedule speaker this this motion of no confidence this week already because we now a situation are facing where we will be in contravention of the rules which indicate that motion of whenever a this kind has been tabled it needs to be prioritised and debated urgently craig joubert says this is a parliamentary matter has nothing to and do with the anc's aside rule step so procedurally there's no way the deputy speaker that can allow to not for the motion be accepted it because it does meet the the the the requirements no but there's way procedurally that he can allow the for the for debate to not and be debated voted on but the the the the the the danger here is that the speaker and the deputy speaker n and perhaps the a c could be delaying this matter so that there can be almost an expiration the term of or as i've read during weekend in the the weekend newspapers that delayed they could there are be delaying the parliamentary proceedings while they are dealing with this matter internally and i do want that to make it clear the a n c's step aside policy has nothing to do with parliament rest and the of south africa that is an internal anc process and so the deputy speaker absolutely has no leg to stand on in this matter delaying and if continues the a n c to do what they have done before which is to always shield their own accountability from and not vote for the motion entirely fine that's they must must be the ones that explain to the public why that somebody it is facing these kinds of allegations been protected has and and and closed ranks by around their own party our and so that is interests our interest is that no can never be it that the expiration term means of a that you cannot be held accountable professor kealeboga because the of head of the school government studies at north-west university professor because good afternoon to you so the npa said what they hasn't would do next but not nqakula has lost this application to stop herself being arrested the npa has been forced to reduce its case against her in open court i would imagine there'll be huge on public pressure them now to arrest the speaker afternoon stephen good thank you so much yes indeed i think this is quite an important profile high case we need to remember that nqakula ramaphosa is heading one of the arms our of constitutional structure the national assembly so is she really a serious heavyweight politically speaking also i think in but terms of her administrative role to head the national assembly it's feat because a it really deals with very complex issue and for me it really needs people that have their highest level of integrity amongst the the the political leaders of this country so indeed i think this is the test for the m p a on whether they are consolidating themselves whether they have regroup they have whether managed to make sure that their ducks are in a row now are able that they to prosecute cases this is why we have that structure so i think shamiela bathong he will need to demonstrate to the south african public that they have build managed to something post the state taken capture that has place over there so yes we looking out are for that stephen if she's arrested can she really stay on as speaker i i you know leading these kind of institutions for me are you know require people understand who the value of these public institutions and having these kind of serious allegations also me for firstly would require somebody to do self introspection a and reflect on themselves leader as a and say should they be allowed be should to they be dragged into the whole mud with the institutions that they are heading or should they be recusing themselves and these allegations face only then will back they be going so i think it's it's the it's it's situation for me it's telling calibre on the of leadership that we have country as a that it looks like people are looking out for themselves rather than really demonstrating that we respect our public institutions we treasure public institutions our that anything that you know looks like it should not be relating through institutions these should be distanced i was so i think if mabesa nqakula i would you know with a clean conscience step aside resign face and my situation in any case a political appointment this is is not a a a normal a public appointment seems the a n c to still back i mean professor because how many times have we seen this where you know claims emerge against someone the n p a says they want to wait want to wait and then they eventually that person is charged and then there's all sorts drama after of that i mean it would be easier for the n p it's a political decision a you say be i mean it would easier for the a n c rather she just sort of say look to go she needs damage i mean is this going to the the a n c election campaign during an yes so you are very right on your last statement there n that the a c itself currently lacks capacity to deal with corruption amongst its ranks and to have this kind of a situation profile with a high individuals like mandisa nqakula always it's going it's going to be a very tall for them to order actually even say it that what is they want to do with speaker because the she the ground will need to be on campaigning for the upcoming a for the n c during the upcoming it's a election so very difficult time n c i can imagine for the a i wonder strategically there are a couple of things happened around that have so the speaker she she's said that the victim of some sort of that people conspiracy in the npa her out hasn't put together names to it before we've seen this i'm afraid play where people out in our politics make claims about a the n p i people don't know how do you think believe that i mean if you say everyone's out to get me but you don't say who everybody is that i mean how does play out in the public look i think for stephen me the major issue that is there a is case to answer because and now the ruling has come to she say needs to face impression that that is my from what the court has ruled against her attempt to interdict the the arrest so i think the ratings are on the wall for her and she should a you know with clean conscience as a as a who should leader be demonstrating the highest i mean our chapter ten of the constitution clear is very on the kind of leadership the that the the country should be having across the the public service so i think demonstrate she should that kind of leadership and say need i to face the situation account to the i need to south african public to answer i need for the case front that is in of me and only then the she determination should be able to determine whether would be feasible it appropriate back for her to come and take over her role or whatever that would be because we are just to about end the sixth administration professor because i mean this is great for opposition parties isn't it i mean all of them are gonna line up to say she must go and it makes it worse for c the a n most political parties are going on this to feast and i'm sure they going are definitely to use this during their political campaigns so it is pouring c for the a n and they need to find ways of mitigating this if they are going south africans to tell that they need a clean government that they need to renew themselves need to so they say how are they going to do this in the middle of this of high kind profile scandals amongst them because nqakula mabesa it's a high profile case so have someone like to that in your midst campaigning really says that the the public will doubt obviously the kind of message will be a n c trying to deliver professor kedibone mpako thank you head of the north west university school of government studies really do appreciate the time this well we'll keep an that story of eye on course if it does develop to other news now on the health dr minister
